Pit #1, Permit M- 2010 -043, Succession of Operators
Awaiting Warranty Notification, Revision SO -1
Dear Mr. Ritchey:
On March 18, 2015, the Division of Reclamation, Mining and Safety completed the review of the
Transfer of Permit and Succession of Operator (SO) application submitted to the Division on March 17,
2015 and called complete on March 18, 2015.
On the SO application form, the right to a 30 day decision was waived, allowing the Division to inspect
the site and recalculate the bond required to finalize approval of the transfer. The estimated liability of
the reclamation bond has been calculated to remain $30,800.00. The new operator must provide the full
financial warranty within 60 days in order for the Division to finalize the SO. In the event Chamberlain
Concrete fails to provide the required bond within 60 days, the SO application will be denied and
Ritchey's Redi Mix & Precast Inc. will continue to be the Permittee of record, and be responsible for the
financial warranty in the amount of $30,800.00.
The transfer of Permit M- 2010 -043 will not be final until the bond submitted by the new operator is
approved by the Division. The current bond will be returned when the SO has been finalized.
If you have any questions, please contact me at 303 866 -3567, ext 8132.
Sincerely,
Elliott Russell
Environmental Protection Specialist
Certified Mail No. 7014 0150 0000 9138 8380, return receipt requested
Cc: Tom Kaldenbach, Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us
John W.
