The pond was inspected on December 10, 2014. <br />Quarterly inspections are to be conducted in compliance with Rule 4.05.9(17): <br />(17) All impoundments shall be examined at least quarterly, by a qualified person designated by <br />the operator, for appearance of structural weakness and other hazardous conditions. The <br />reports shall be retained at or near the mine site, and a copy of the report shall be <br />submitted to the Division on a quarterly basis, or other approved submittal frequency. <br />The King II Sediment Pond Inspection report is in full compliance with this rule. <br />The quarterly pond inspection reports submitted for King I are in compliance with 4.09(17). <br />While quarterly inspection by a P.E. is certainly allowed, it is not required by our Rules. If GCC <br />were to opt to conduct its own inspections of the King I ponds quarterly each year (as is done at <br />King II), and have an Engineer inspect and certify once per year, that would be acceptable to the <br />Division. If this approach is selected, the quarterly pond inspection reports for King I and King <br />II could then be combined into a single submittal. <br />If you have any questions or need additional information, please contact me. <br />Sincerely, <br />Marcia L.
