F c�I D N R V <br />16 March 2015 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />Tom Bird, Manager of Coal Services <br />GCC Energy, LLC <br />6473 County Road 120 <br />Hesperus, CO 81326 <br />Re: King Coal Mine (Permit No. C- 1981 -035) <br />Review of Coal Mine Waste Bank Inspection Report <br />4th Quarter 2014 <br />Dear Mr. Bird: <br />The King Coal Mine operates a permitted Coal Mine Waste Bank (Refuse Pile), located at the <br />King I Mine surface facilities. A certified inspection report covering the 4th Quarter of 2014 was <br />submitted by GCC Energy, LLC (GCC) on 8 January 2015. Attached to this letter, please find a <br />table documenting the Division's review of the subject inspection report. <br />In the Division's 18 July 2014 review of reports which spanned the 3rd Quarter of 2012 through <br />the 2nd Quarter of 2014, we found that certain elements of the inspection requirements for Coal <br />Mine Waste Banks were not being adequately addressed. In that letter, we requested that GCC <br />ensure that the Refuse Pile is inspected pursuant to the requirements of Rules 4.09.1(11) and <br />4.10.2 for future reports. Significant progress has been made in this regard, although a few <br />points remain to be addressed; please refer to the attached table for details. (A number of these <br />items are repeated from the Division's 7 January 2015 review of the 3rd Quarter 2014 CMWB <br />Report — that review was not issued prior to the company conducting the 4th Quarter inspection.) <br />Please ensure that future Coal Mine Waste Bank Inspection Reports address the requirements of <br />4.09.1(11) and 4.10.2 in full. <br />Please contact me with any questions you may have regarding this topic. <br />Best regards, <br />Marcia L.
