PERMIT #: M- 1977 -439 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: March 11, 2015 <br />OBSERVATIONS <br />This was an inspection conducted as follow up and confirmation of information provided in a spill report forwarded from <br />CDPHE to DRMS for this site. The sequence of events is summarized below: <br />March 9- <br />DRMS received CDPHE spill report stating that on March 6 approximately 10 gallons of sediment water from wash pond <br />escaped the wash pond to Cache La Poudre River through a previously unknown discharge pipe. Operator immediately <br />repaired the leak and halted the discharge. Operator notified CDPHE spill report line of the release. <br />DRMS attempted to call Operator representative Walt Wright. Unable to contact, left voice mail. <br />Walt Wright returned phone call and left message with DRMS. <br />March 10- <br />DRMS contacted Operator Walt Wright via phone and discussed release event. DRMS confirmed information in CDPHE <br />spill report, that the pipe had been closed off, and that repair efforts implemented by the operator have been successful in <br />stopping any further release from the sediment pond. Mr. Wright also stated that he was in contact with Kathy Rosow and <br />Joe Campbell of CDPHE WQD to follow up with any additional required reporting (5 -day follow up report). DRMS <br />scheduled follow up inspection of the release site for following morning - March 11. <br />March 11- <br />DRMS met on -site with operator representatives Walt Wright (environmental compliance), Julie Mikulas (land <br />manager /permitting) and Tim Niesent (site operations) and proceeded to location of reported leak — see attached photos. <br />The release site was observed to be as reported by operator. Wash water from the channel between wash plant and <br />settling pond had escaped the channel through a previously unknown and plugged culvert down the bank to the Cache La <br />Poudre River. <br />As can be seen in the attached photos, there were no observable impacts to the river or area downstream of the culvert <br />other than a small amount of sediment below the culvert that had settled out of the wash water. The culvert was not <br />discharging at the time of the inspection. The operator representatives stated that upon its discovery the culvert had been <br />excavated, the inlet crushed closed with a backhoe, and re -buried below the wash water channel.
