Box 7650 <br />Colorado Springs, CO 80933 <br />. <br />COIOT�J Depatnnent <br />of P Mc <br />Health <br />and Environment <br />ACTION: APEN REQUIRED <br />PERMIT EXEMPTED <br />RE: Gravel pit located at the Phillips Ranch property in Sec 36, T1 9S and Sec 1, T20S, R69W, <br />Fremont County, Colorado. <br />Dear Mr. Kraig: <br />Your application was received by the Division and a preliminary analysis was completed. The <br />Division determined that no emission permit will be required for the above referenced source since <br />the production rate will be 70,000 tons per year or less. An Air Pollutant Emission Notice (APEN) is <br />required, however, since uncontrolled emissions of particulate matter will be more than 2 tons per <br />year. <br />This exemption from permit requirements is issued in reliance upon the accuracy and completeness <br />of information supplied by the applicant and is conditioned upon construction, installation, and <br />operation in accordance with this information and with representations made by the applicant or <br />the applicant's agents. Specifically, this exemption has been granted provided that the following <br />information is accurate and complete: <br />The production rate does not exceed 70,000 tons per year. Annual records of the actual <br />production rate shall be maintained and made available to the Division for inspection upon <br />request. <br />2. The applicant shall follow the fugitive dust control plan as submitted with the application. <br />Any changes with respect to the original submittal which would result in an increase in production <br />above 70,000 tons per year automatically nullifies this exemption. Before actually making any such <br />change, you must apply to the Division for a construction permit based on the anticipated change. <br />A permit must be obtained BEFORE implementing the change. <br />In accordance with C.R.S. 25 -7- 114.1, the Air Pollutant Emission Notice (APEN) associated with <br />this source is valid for a term of five years. The five year term for this <br />expires. APEN expires on February <br />29, 2002. A revised APEN shall be submitted no later than 30 days before the five year term <br />043/0108/001 <br />
