5. Lease Payment. Lessee agrees to pay to Central four - hundred - dollars and no cents
($400.00) per acre -foot for the Water. The total owed to Central by Lessee is ninety -
thousand two- hundred - eighty -four dollars and no cents ($90,284.00) which shall be
paid upon the signing of this Agreement. The Lease payment is non- refizndable and
is owed regardless of whether Lessee uses the Water.
6. INTO continuing rights in Water. Any quantity of the Water which Lessee has not
authorized to be released from storage by December 31, 2015 above shall become
the property of Central without any reduction in the amount paid to Central
pursuant to this Agreement. Lessee shall have no continuing rights in and to the
Water.
7. Release Responsibilities. Central shall release the Water on the schedule set forth
above. No changes to the schedule shall be made unless agreed to by both the
Central and Lessee in writing.
Lessee shall be responsible for taking such actions as are necessary in order to take
delivery of and obtaining augmentation credit for the Water and shall be responsible
for all costs associated therewith. Lessee shall indemnify and hold Central harmless
from any and all damage which may result from its operations under this
Agreement.
Lessee's Intended Use. Lessee intends to utilize the Water to offset depletions from
its gravel mining operations at Shores Reservoir, Bernhardt Reservoir, LaPoudre,
LaPoudre North, Firestein, Tigges, and Roberts gravel mines. Lessee shall be
responsible for obtaining such Federal, State and Local Governmental approvals as
are necessary for it to use the Water for its intended purposes, including such
approvals as may be required pursuant to Colorado water law.
