Mr. Peter Wayland <br />Gardels SWSP <br />March 9, 2015 <br />Page 3 of 6 <br />depletions from the exposed ground water surface area that may occur during the assumed ice <br />covered period (the months of January, February and December) for any time that the pit is not <br />completely covered by ice. <br />The lagged depletions from evaporation at the Gardels Pit were estimated by the <br />Applicant's consultant using the Integrated Decision Support group's Alluvial Water <br />Accounting System (IDS AWAS) stream depletion model. The aquifer characteristics used in <br />the model are: transmissivity (T) = 56,100 gallons per day per foot; specific yield (SY) = 0.2; <br />the distance from the centroid of the exposed ground water to the stream = 444 feet (Pond 1) <br />and 275 feet (Pond 2); and the location of the parallel impermeable boundary was estimated <br />to be 1,400 feet from the stream. <br />Replacements <br />Replacement water for this pit will be made available throughout the year from a lease <br />of fully consumable water from Loveland's Water and Power Department. A copy of the lease <br />associated with the mining operation was provided to the State Engineer's Office with the <br />SWSP request and is attached to this letter. The duration of the lease is for a term of twenty - <br />five years ending on December 31, 2022. <br />Under the terms of the lease, replacements can be made using a variety of water <br />owned by Loveland including, but not limited to, Windy Gap reusable effluent, Loveland <br />Storage Reservoir water as decreed in case no. 82CW202A, and Colorado Big Thompson -( "C- <br />BT") Project water. In the event that Loveland plans to use C -BT water as a replacement <br />source, Loveland shall comply with the Interim Rule issued by the Northern Colorado <br />Water Conservancy District ( "Northern District ") in May 2005, regarding the use of C -BT <br />Project water in substitute water supply plans. Prior to the use of C -BT Project water, <br />Loveland is required to notify this office, the division engineer and the water commissioner of <br />the amount of C -BT Project water dedicated to this plan and provide a copy of the Northern <br />District's approval letter as required by paragraph I(g) of the Northern District's May, 2005 <br />Interim Rule. <br />The monthly depletions and replacement requirements are found on the attached <br />Table AI.2 <br />Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with §37 -90- <br />137(11), C.R.S. subject to the following conditions: <br />1. This SWSP shall be valid for the period of November 1, 2014 through October 31, 2015, <br />unless otherwise revoked, modified, or superceded by decree. The plan will be <br />extended until October 31, 2016 if the Applicant can demonstrate that a water <br />court application for a permanent plan for augmentation was filed with the <br />Division 1 water court. If this plan will not be made-absolute by a water court action <br />by the plan's expiration date, a renewal request must be submitted to this office with <br />the statutory fee (currently $257) by September 15, 2015 or September 15, 2016. <br />
