Exhibit S — Permanent Man -Made Structures <br />18. Please find included in this mailing copies of signed and notarized man-made <br />structures agreements with structures owners DJ Fredrickson and Custer County <br />Road and Bridge Dept. <br />General Questions and Comments <br />19. Please find included in this mailing a copy of the proof of publication of the <br />notice for application for conversion of permit M- 1994 -114. <br />20. Please find included in this mailing a copy of the certified mailings to all <br />landowners within 200'of the Affected Land. <br />21. The State's Historic Preservation Officer's comments are duly noted. Since the <br />mining operation will not proceed any closer than 100'from the riparian zone and <br />potential ancient camp site(s) and the bulk of the area to be mined was reportedly <br />used for agricultural purposes during the homesteading years, incursion of historic <br />or cultural resource is expected to be of low likelihood. <br />22. Bureau of Land Management comments underscore the distinct differences in <br />homestead land title administrations regarding split - estate considerations of title <br />transference in the late 1900's compared to the 1922 title transfer from the federal <br />government to Mr. A. Hess, retaining mineral ownership on the land. In the <br />ensuing years, the original land boundaries have been erased by large land <br />purchases and sub - division to parcels better suited for present day purpose. The <br />result is that a little more than half of the Phase 3 area contains mineral owned by <br />the US Government and administered by the USBLM. The mine operator <br />commits that prior to disturbance of land within the Phase 3 area, a mineral lease <br />agreement with the USBLM will be completed. <br />23. The Colorado Division of Parks and Wildlife comments regarding soils and <br />erosion control efforts are presently employed to minimize topsoil loss and <br />erosion of soils from exposed ground and roadways. The Division's comments <br />regarding other aspects of the site are duly noted regarding livestock impacts and <br />weed monitoring via scheduling noxious weed inventories and follow up as <br />needed with control by county weed specialists, who have been contacted in this <br />regard. The seed mix will be revised to include western wheatgrass, blue grama <br />grass, sheep fescue, fringed sage, and alfalfa. <br />Copies of the revised maps and plan narratives are included in this mailing for insertion <br />into the appropriate place in the application document.
