COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />March 6, 2015 <br />Norman & Charlene Einspahr <br />12840 Brighton Road <br />Brighton, CO 80601 <br />Re: Pit 29, DRMS File No. M- 1980 -183 <br />Implementation of a french drain <br />Dear Mr. and Ms. Einspahr: <br />On February 25, 2015, the Division of Reclamation, Mining and Safety (Division) received your letter <br />regarding concerns about your flooded pasture and implementation of the proposed french drain. The <br />Division is in the process of addressing your concerns in the quickest manner possible. The Division <br />would like to address a few of your concerns identified in the letter. The Mined Land Reclamation <br />Board (Board) in conjunction with the Division is requiring the Operator to submit a Permanent <br />Groundwater Mounding Mitigation Plan (permanent plan). The Operator is responsible for selecting a <br />method to comply with the required permanent plan. The method proposed by the Operator is subject to <br />the Division's review and approval. The Operator must obtain legal right to enter from the landowner to <br />construct the proposed french drain (by no means is the Division requiring the Einsphars to grant legal <br />right to enter to the Operator).
