r <br />9/14/201? <br />Dear Colorado Department of Transportation and Whom Ever Else This May Concern; <br />For the past several months it seems that a misconception has been in place over the ownership <br />of the Dollerschell Pit M79 -160 in Logan County, Colorado. As I have stated several times to <br />CDOT, Robert and I own the property, but Mr. Schure owns the mineral rights to the property. <br />Since this seems to have confused some, I will attempt another approach, Robert and i are the <br />Surface /Land owners and Mr. Schure is the Mineral Rights owner. Since Mineral Rights ownership <br />supersedes any Surface /Land ownership according to Colorado Law. Mr. Kym Schure has <br />negotiation power and right of access and egress over the Dollerschell Pit, Mr. Schures mineral <br />reservation is recorded in Book 917 at Page 734 of the Logan County Records dated June 17, <br />1998. <br />As the Mineral Rights Owner, Mr. Kym Schure retains sole discretion and authority regarding <br />any /all negotiations; decisions and benefits over the Dollerschell Pit. This authority includes but <br />is not limited to rights of access /ingress and egress, any /all materials within the land extending to <br />the property boundary lines and the sole right to enter into any /all contracts and agreements <br />related to the described mining area. As the Surface /Land owners, Robert and I hold no claims, <br />entitlements or influence upon the decisions and resulting agreements /benefits derived by Mr. <br />Kym Schure in any /all matters associated with this gravel pit and the ultimate disposition of this <br />area <br />Let this document serve as a legal declaration regarding the authority, rights and privileges <br />regarding CDOT "Dollerschell Pit" area. Upon the following signatures, this document attests to <br />the acknowledgment of the proprietary facts and validated completely of the signers free will and <br />truthfulness of said document without exception. <br />Thank you for your time in this matter.
