OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM /POSSIBLE VIOLATION: Failure to comply with the conditions of the approved reclamation permit <br />pursuant to C.R.S. 34- 32.5- 124(1). The operator failed to follow the approved permit by affecting area and <br />removing old growth trees within the 100' setback distance from Boulder Creek. <br />CORRECTIVE ACTIONS: The operator shall immediately clearly mark the 100 foot setback distance from Boulder <br />Creek, backfill all excavations within the setback distance, and restore the area within the 100 foot setback <br />distance to original grade. The affected area within the 100' setback distance will then be top - soiled, finish <br />graded, and seeded with the final reclamation seed mix. Large trees that were removed shall be replaced with <br />appropriate species at a 3:1 basis as recommended in the DOW comment letter dated August 7, 2005. This <br />reclamation of the setback area shall be completed no later than May 31, 2015. <br />CORRECTIVE ACTION DUE DATE: 5/31/15 <br />Page 1 of 4 <br />
