t <br />East Rigden Pit SWSP <br />February 27, 2015 <br />Page 3 of 6 <br />• Arthur Irrigation Company Shares (WDID 0300918)(391.36420 shares) <br />• Larimer County Canal No. 2 Irrigation Company Shares (WDID 0300914)(67.56150 <br />shares) <br />• New Mercer Ditch Company Shares (WDID 0300913)(44.81716 shares) <br />• Warren Lake Reservoir Company Shares (WDID 0303804)(83.18920 shares) <br />The water delivered to Fossil Creek Reservoir will be either Southside Ditches water rights as <br />changed in 92CW129 or Southside Ditches effluent. The decree entered in case no. 92CW129 lists the <br />Fossil Creek Reservoir Inlet Canal (WDID 0300927) as an alternate point of diversion and the Fossil <br />Creek Reservoir as an alternate point of storage for the Fort Collins Southside Ditches Water Rights. <br />In addition, the City diverts its Southside. Ditches Water Rights for use by its treated water <br />customers. The effluent produced by this use is delivered from Fort Collins's Drake Water <br />Reclamation Facility (WDID 0302314) to Fossil Creek Reservoir before ultimately returning to the <br />river through the Fossil Creek Reservoir Outlet Ditch located in the NEI /a SWI /a Sec. 10, T6N, R68W, 6th <br />P.M., approximately 5 miles downstream of the East Rigden Pit site. Replacement water may only be <br />delivered via the Fossil Creek Reservoir Outlet Ditch when there are no intervening calling water <br />rights, as verified by the Water Commissioner. Acceptable accounting must be provided and <br />approved by the Division Engineer prior to using water stored in Fossil Creek Reservoir for <br />replacement purposes. <br />There are no dry-up points on the Cache la Poudre River between the City's Drake Water <br />Reclamation Facility and the East Rigden Pit; however, there are diversions that could potentially <br />sweep the river between Joe Wright Reservoir and the City's Mulberry Wastewater Treatment Plant <br />(WDID 0302313) and the East Rigden Pit. It is the Applicant's responsibility to track the daily call and <br />make arrangements as necessary to ensure the replacement water is bypassed or otherwise delivered <br />to the point of depletions. <br />All replacements will be based on actual depletions determined from tracking actual diversion <br />volumes and sources. Replacement deliveries will be reported in the Fort Collins existing accounting. <br />Additional releases for transit losses wilt be provided based on an assumed transit loss rate of 0.25 <br />percent per river mile, unless otherwise required by the Water Commissioner. <br />Long Term Augmentation <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division <br />of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply with <br />the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the <br />protection of water resources. The April 30, 2010 letter from DRMS requires that you provide <br />information to DRMS to demonstrate you can replace long term injurious stream depletions that <br />result from mining related exposure of ground water. <br />According to the SWSP request, the City is in the process of amending the mining permit for <br />the East Rigden Pit to authorize a lined reservoir as a post- reclamation land use. Construction of a <br />compacted clay liner around the Fort Collins Parcel was completed in September 2014 and a 90 -day <br />leak test was commenced on January 5, 2015. Upon approval of the compacted clay liner by the <br />State Engineer's Office, the Applicant will be in compliance with approach no. 4. <br />Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with § 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of March 1, 2015 through February 29, 2016, unless <br />otherwise revoked, modified, or superseded by decree. Provided that the compacted clay <br />
