The following inspection tonics were identified as having Problems or Possible Violations. OPERATORS
SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE
WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a
Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land
Reclamation Board will consider possible enforcement action.
INSPECTION TOPIC: Gen. Compliance With Mine Plan
PROBLEM /POSSIBLE VIOLATION: Failure to comply with the conditions of the approved reclamation permit
pursuant to C.R.S. 34- 32.5- 124(1). The operator failed to follow the approved permit by affecting area and
removing old growth trees within the 100' setback distance from Boulder Creek.
CORRECTIVE ACTIONS: The operator shall immediately clearly mark the 100 foot setback distance from Boulder
Creek, backfill all excavations within the setback distance, and restore the area within the 100 foot setback
distance to original grade. The affected area within the 100' setback distance will then be top - soiled, finish
graded, and seeded with the final reclamation seed mix. Large trees that were removed shall be replaced with
appropriate species at a 3:1 basis as recommended in the DOW comment letter dated August 7, 2005. This
reclamation of the setback area shall be completed no later than May 31, 2015.
