<br />SPECIAL ADMINISTRATOR'S DEED
<br />(to joint tenants)
<br />THIS DEED is dated December A�k, 2013, and is made by John Willard, the Grantor, as Special
<br />Administrator of the Estate of Mildred Moser, deceased, to Gary McCall and Virginia McCall, the
<br />Grantees, whose legal address is 918 S. Ash Street, Yuma, CO 80759.
<br />WHEREAS, the Decedent died on the date of August 7, 2008, and Grantor was duly appointed Special
<br />Administrator of said estate by the District Court in and for the County of Yuma, State of Colorado, Case
<br />No. 2012 PR 2, on the date of January 6, 2012, and is now qualified and acting in said capacity;
<br />NOW, THEREFORE, pursuant to the powers conferred upon Grantor by the Colorado Probate Code, for
<br />and in consideration of ten dollars and other good and valuable consideration, Grantor does hereby
<br />convey, assign, transfer and release unto the Grantees, not in tenancy in common but in joint tenancy,
<br />all Decedent's interest in the following described real property, all situate in the County of Yuma, State of
<br />Colorado:
<br />The West Half of the Southeast Quarter (W'hSE' /<) of Section Nine (9), Township One (1)
<br />South, Range Forty-eight (48) West of the 6h P.M.;
<br />EXCEPT any and all minerals or mineral rights underlying the property, which minerals and
<br />mineral rights were previously conveyed by that certain Special Administrator's Deed dated
<br />September 18, 2013, recorded September 19, 2013 as Reception #558330, Yuma County,
<br />Colorado records, and specifically EXCEPTING all interest in the gravel underlying the the
<br />above - described lands, said interest including but not limited to the existing permit and
<br />proceeds under that certain lease dated November , 2005 with Yuma County, Colorado (said
<br />lease having a term of ten years from January 1, 2006 to December 31, 2015, with an option to
<br />renew for an additional five years) concerning that certain construction materials regular
<br />operation reclamation gravel pit (total 38.57 acres) referenced in the Resolution of the Yuma
<br />County, Colorado Commissioners recorded August 21,2008 as Reception #539004, Yuma
<br />County, Colorado records, together with the right of entry to mine and remove said gravel.
<br />With all appurtenances.
