PERMIT #: M- 2003 -001 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: February 24, 2015 <br />OBSERVATIONS <br />This was a Surety Reduction (SR) inspection conducted by DRMS at the Bestway Concrete Nissan Farm <br />Resource site. There are 134.21 acres currently permitted at this 112c site. The inspection was conducted by <br />Eric Scott of DRMS. The DRMS representative traveled to the site with permittee representative Mark <br />Johnson of Bestway Concrete at approximately 0930. <br />The site is currently being used by the Central Conservancy District as "in- ground water storage ". The <br />adjacent ditch is used to supply several shallow infiltration areas. The stripped topsoil and overburden from <br />the construction of the infiltration ponds has been stockpiled near these areas on the site. The SEO has <br />previously approved the slurry wall that has been installed at the site, and the bond reduction for the <br />approved slurry wall has already been processed by the Division (SRI in 2008). Unfortunately, the slurry wall <br />at this site was damaged by the 2013 flood event. The slurry wall has been repaired and is currently <br />undergoing leak testing for SEO re- certification. <br />DRMS noted during this inspection that there has been some recent additional mining and surface disturbance <br />at the site to support the nearby flood damage re- construction activities. There is a recently excavated area <br />where fill material was removed, a portable batch plant located on the site, and a construction equipment <br />fueling, staging and parking area totaling approximately 10 acres. <br />The current posted bond for this site is $547,300. On February 5, 2015 a SR revision (SR02) was requested by <br />the permittee based on the previous approval of the slurry wall by the SEO, and the limited nature of the <br />current disturbance at the site. DRMS believes that due to the slurry wall being damaged by the flood and not <br />yet recertified by the SEO, and the presence of the additional excavation and surface disturbance at the site, <br />that the surety reduction as proposed is not approvable at this time. The bond proposed in the SR provided <br />($66,000) would be insufficient to reclaim the existing disturbance at the site, let alone any additional future <br />mining activity. <br />Reclaiming just the current disturbance at the site would include at a minimum: sloping of the banks of the <br />current excavation within the slurry wall to 3:1 or flatter, removal of the batch plant, ripping and grading out <br />all the remaining disturbed but un -mined areas, replacing the topsoil, and revegetation of the entire site as <br />approved in the current reclamation plan for the site. <br />The permittee should provide a revised reclamation estimate that includes estimated costs for at least the <br />above items, as well as any additional disturbance planned within the next 12 months and the standard <br />indirect costs to DRMS by Friday, March 13 if the SR process is to continue.
