We have yet to hear back on this issue <br />either. <br />You had stated to me on the telephone in September that WFC will not get in the middle <br />of land disputes. We have discussed the situation with our neighbors and received a <br />Disclaimer of Interest from Mr. Goforth. <br />You had also stated that WFC has already paid SMPA for the coal removed from beneath <br />the property, however, the spreadsheets provided by WFC shows otherwise. <br />The maps WFC has provided to DRMS over the years are not accurate as it pertains to <br />our property. <br />The reports that WFC has been submitting to DRMS are not accurate for over the past <br />nineteen years. <br />We have not mentioned the above information to DRMS, nor have we asked for their <br />assistance in figuring the precise tonnage that was removed from under our property. We <br />only served Mr. Berry with a copy of the cover page showing a default of unpaid royalty <br />without giving him the specifics. <br />We all know that WFC has made many mistakes and errors in the past and now that Tri- <br />State is managing the operations, things appear to be operating a whole lot smoother and <br />building a good reputation with the community. <br />However, WFC remains to be in violation of the settlement agreement as it pertains to the <br />vegetation/hay production and grazing. So far to date, we have not received one penny in <br />revenue, compensation or consideration for the vegetation taken off our property by WFC <br />the last two years on the same acres royalties were not paid for. <br />9 acres at 1.61 tons per acre totals 14.6 tons @ $300.00 per ton = $4,368.60 for 2013, <br />9 acres at 1.61 tons per acre totals 14.6 tons @ $285.00 per ton = $4,150.20 for 2014 for <br />a total of $8,518.80 owed for hay taken. <br />WFC owes $137.18 for the 2014 grazing. <br />Total amount due for hay and grazing from WFC: $8,655.98 <br />We would still consider exchanging the amounts due from WFC for properties we <br />identified with Mr. Gray. Until then, we will continue to charge 8% annually for the <br />$8,655.98 amount due and currently have no plans on filing a Corrected 1099 -C. <br />We are confident that we will prevail should WFC move forward in a formal IRS dispute <br />on the amount of $421,796.61 in box 2 on the current 1099 -C. We reserve the right to <br />file a corrected 1099 -C to change the tonnage per acre from $10,474.04 to $12,373.15 <br />(actual figures provide by WFC) increasing the figure in box 2 to $500,973.96 and <br />Page 3 of 4 <br />
