CERTIFIED MAIL <br />RETURN RECEIPT NO. 7012 2920 0000 9187 1063 <br />February 20, 2015 <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit No. M -1992 -069 - 83`d Joint Venture - Annual Report <br />Ladies and Gentlemen: <br />9 <br />AGGREGATE <br />INDUSTRIES <br />Enclosed is the annual report form for the above - referenced permit for year ending January 26, 2015, <br />together with Aggregate Industries' (Al) Check No. 4000071907 in the amount of $791.00 for the annual <br />fee. In accordance with reporting requirements for this operation, well monitoring data from 2014 is also <br />submitted herewith. <br />With the exception of establishment of re- vegetated areas, all mining and reclamation activity at this site <br />has been completed in accordance with the Exhibit F Reclamation Plan as approved by the Division under <br />TR -07 on August 22, 2011. A copy of said map is enclosed as the annual report map. <br />As noted in the annual report for permit year ended January 26, 2014, regional flooding in September, <br />2013 resulted in a section of the Boyd Freeman ditch pipe on the west boundary of the site <br />failing and water breaching the pit slope in that area. Additional flooding in May, 2014 further <br />impacted the slope in this area. The ditch company indicated, following the 2013 flood event, <br />that the breached area would be repaired but to date has not done so. Other areas of the site will <br />be evaluated for re- seeding and weed management is on- going. <br />As indicated in the annual report letter and enclosures for permit year ended January 26, 2013, all wetland <br />mitigation requirements and conditions at the site under Section 404 Permit No. 199280589 was deemed <br />complete by the Corps of Engineers on July 16, 2012. <br />As noted in documents related to TR -09, submitted to the Division on September 12, 2012 and approved <br />by the Division September 24, 2012, an extension of time for mitigating groundwater exposure at the site <br />has been granted based upon a variance issued by the State Engineers Office. The site is included in AI's <br />2015 Combined Substitute Water Supply Plan while Al continues to work towards resolution of various <br />legal matters associated with the site. <br />Very truly yours, <br />Connie N.
