tidmta-et 0 C' 6�W�L, <br />REGE!, <br />February 20, 2015 <br />DIVISION Or R�GiN;- <br />MINING AND SAFE <br />/"' Colorado Division of Reclamation and Mining <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />v/RE: Implementation of French Drain on 12840 Brighton Road, Brighton, CO 80601. <br />To Whom it May Concern: <br />We, Norman and Charlene Einspahr, reside at 12840 Brighton Road, <br />Brighton, CO 80601. Our property (as mentioned) borders Brannan Sand and <br />Gravel Pit #29, directly to the south. <br />Let it be noted, our property (pasture) at 12840 Brighton Road, has been completely <br />flooded for the last three years. The flooding occurred in 2012, and has remained in <br />that state since. Our neighbors, The Bromley's whom reside across the street to <br />West, as well as ourselves have contacted the Bureau of Reclamation in regards to <br />this problem multiple times. Letters were sent, and phone calls were made stating <br />our concerns with this unresolved problem and property damage. There has been <br />unresolved flooding damage to pasture, as well as rental property. <br />The Bureau of Reclamation sent several representatives to the mentioned <br />properties for an inspection. In a short matter of time, the Bromley's were able to <br />have their flooding issues resolved. However, our property at 12840 Brighton Road <br />remains flooded with rising water. <br />At that point, we contacted The Bureau of Reclamation again, and requested they <br />come back to see our flooding issues had not be resolved. The Bureau of <br />Reclamation representatives came to inspect our property again, determining that <br />in fact, we still had the flooded pasture and rising water. At that time, they <br />suggested the implementation of a French Drain on our property. <br />We are not in agreement with the installation of the French Drain for several <br />reasons: <br />1. Installation of a French Drain would directly impact the resale value of our <br />property. <br />2. The uncertainty of who will be responsible for maintaining the drain. <br />3. What happens to the drain maintenance after Brannan Sand and Gravel are <br />done with pit #29. <br />4. If and when, the Brannan Sand and Gravel Pit #29 property takes new <br />ownership, the new property owners will view the French Drain as a non - <br />maintenance issue for them and will argue it is not their problem, and was in <br />fact a prior owner issue that does not transfer to the new ownership. <br />5. We do not feel the French Drain Implementation is a true solution to our <br />flooding problem, and find it unfair that under no doing of our own, we will <br />
