1. INTRODUCTION (6.4.21(1) <br />In a letter dated September 10, 2013, the Division of Reclamation and Mining Safety (DRMS) <br />notified the operator that the Sooner Lucky Strike Mine (Permit M1982 -020) was being <br />redefined as a Designated Mining Operation under its interpretation of the Colorado Mined <br />Land Reclamation Act, (CRS § 34 -32 -101), more specifically CRS §34 -33 -103 (3.5)(i-ii). That <br />order requires implementation of Rule 6.4.21. In a letter response to DRMS dated October 10, <br />2013, John McGrath, of Aspen Mineral Resources, had to concur with the DRMS interpretation <br />and order. The purpose of this plan is to meet the requirements of Rule 6.4.21 that requires <br />development of an Environmental Protection Plan. <br />The plan describes how the operator will assure compliance with the provision of the Act and <br />rules to protect all areas that have the potential to be affected by designated chemicals, toxic <br />or acid - forming materials by constructing an Environmental Protection Plan (EPP). The <br />potential for acid mine drainage (AMD) has been reviewed and it has been found that the Lucky <br />Strike Mine does not currently have the capability of producing acid generating rock, thus no <br />AMD drainage, and, as the result, no possibility of acid tailings release (ATR) from processing <br />operations associated with the permit. Additionally, there are no man -made openings that can <br />gravity discharge water from the mine to surface waters, nor are there any heap leach pads, <br />land application sites, insitu operations, or uranium mining or processing associated with the <br />permit. Based on the Act and associated regulations, the specific areas that have potential to <br />produce environmental hazards include the mill and the fuel storage area, with their associated <br />potential for spills. <br />2. MAPS (6.4.21(1) <br />The Environmental Protection Plan includes four maps identified as follows: <br />On -site Chemical Storage Map <br />Location of Wells, Springs, and Watercourses Map <br />Groundwater Sampling Plan Map <br />Precipitation Surface Flow Directions Map <br />
