THE NEW CACHE LA POUDRE IRRIGATING COMPANY <br />THE CACHE LA POUDRE RESERVOIR COMPANY <br />7 (970) 352 -0222 <br />i <br />EXHIBIT D (REVISED) <br />Mining Plan <br />We are constructing an agricultural pond that will be 9.13 acres in size (total disturbed area will be 13 acres, <br />to include pond and embankment). It is estimated that we will create approximately 125,000 yards of waste <br />material. The waste material from this pond will be sold but not marketed. As such, the timing of <br />construction is not known at this time, but, given the limited amount of material, will be short in duration. <br />1. Mining is estimated to begin in the spring of 2015 and end prior to spring of 2016. No geotechnical <br />testing or material characterization is anticipated due to the minimal size of the site. <br />a. Material for pond embankment construction will be identified and stockpiled for pond <br />construction. <br />b. Loading and hauling away of the waste material will occur as needed for construction. <br />2. Mining will occur with typical excavation equipment and will likely include scrapers, track hoes, and <br />loaders. <br />3. Vegetation is sparse in the area. Soil supporting plant growth will be stored in the mining area and used <br />in the reclamation process. <br />4. There will be no office, shop, plant, or underground openings in the mining area. There will be no <br />processing equipment at the site. The mined material will be transported off property by tractor <br />trailers. The mining area will be accessed by an existing road on the property, currently used by the <br />property owner. <br />5. Pit excavation will be confined to the area shown in Exhibit C, Attachment 5. The excavation is <br />anticipated to be done from south to north. The haul road and access to the county road are <br />established. <br />6. There will be no water used with the mining operation, other than for dust control as needed. <br />7. The encountering of ground water is not anticipated. <br />8. The mining will be done above the water table. <br />9. Colorado water laws and regulations governing injury to existing water rights is not applicable in this <br />operation. <br />10. The affected area is located in a rural area; no refuse, acid, or toxic producing materials will be <br />encountered.
