We discussed this issue at hand with our neighbor to the east and we were told that he never received <br />any monies for royalty. Mr. Goforth provided us a signed notarized Disclaimer of Interest that has been <br />recorded with the Montrose County Recorder's Office. <br />WFC could no longer use the excuse that our neighbor was claiming our land on the east. <br />I have enclosed the following documents for your review in order to know the facts and the reason for <br />my request of a formal hearing. I am seeking WFC to acknowledge our legal boundaries, to execute and <br />manage the mining operations according to the property described in the mining lease and the survey <br />that has been completed and recorded September 16, 2014, correcting all documents and maps they <br />have and will produce and provide to DRMS and the general public. <br />1. Copy of Recorded Survey contracted by WFC. <br />I have submitted this request for a formal hearing to comply with the timeframes required by the rules <br />and regulations. If my concerns can be settled, then I reserve the right to withdraw my request for a <br />formal hearing within a reasonable time. If I do not receive a result satisfactory to me, I will elect to <br />move forward with the formal hearing. <br />I respectfully request that you encourage WFC to produce accurate maps according to factual and legal <br />deeds of record and not what they choose to provide according to their assumptions and fence lines. As <br />WFC states, "They do not want to get in the middle of land ownership designations and disputes ". Nor <br />should they assume that responsibility. By WFC submitting to DRMS Map 2.03.4 -1 along with MR -92, <br />again shows their disregard of legal boundaries that have been backed up with their own survey <br />performed June, 2014 and the disclaimer of interest from Mr. Goforth, and other legal documents of <br />record with the Montrose County Recorder's Office. <br />Thank you for your consideration.
