JoEllen Turner <br />970 -864 -7682 p.3 <br />- Y4 <br />cover crop. when the temporary access was built, bench one <br />materials and gravel was put on to of BARX soils, BARX 2 E <br />soils and this must be removed immediately and brought back <br />up to grade so that this Prime farmland property can continue on <br />its schedule with PR -08 and a court order. It was a settlement <br />agreement backed by the courts and enforced by the courts if <br />YOU are in violation of this being completed. This AFFECTS <br />NO ONE except the MORGANS. It was our property to begin <br />with, it is still our property, and we are the ONLY ones with <br />prime farmland that has been mined and it must be returned as <br />good as or better than it was and must be returned to the <br />EXACT amount that it was prior to mining. The 2.83 acres, 60 <br />feet along the west side of our property was just a temporary <br />access for those neighbors through THE MIDDLE of our alfalfa <br />field. It was not a public road, it was a temporary access that <br />now must be completed by removing the bad stuff off our <br />topsoil so we can continue farming. It was not mined by <br />Western Fuels. The public comment period for a technical <br />revision has been completed which is TEN DAYS and this is a <br />rule and regulation that cannot be altered or changed by the <br />STATE. This is also a FEDERAL rule. We were instructed by <br />the STATE that as soon as they had the public comment period <br />and if there were no comments, that this would be accepted as <br />quickly as possible because of the delicate situation that it has to <br />deal with. You are in direct violation of the rules and <br />regulations and you are also hindering the completion of our <br />prime farmland property, and in direct violation of PR -08 and <br />of a court order. The contractors are available to finish this <br />completion and by you violating the rules and regulations, the <br />property will not be completed and if it is not, then you will be <br />
