M <br />DNR <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />January 29, 2015 <br />Jean De Ridder <br />Total EEtP USA Oil Shale, LLC <br />659 Middlefield Road <br />Palo Alto, CA 94301 <br />Re: Total E&tP USA Oil Shale, LLC, Preas Exploration Project, File No. P- 2014 -022, Notice <br />of Deficiencies. <br />Dear Mr. Ridder <br />The Division of Reclamation, Mining and Safety (DRMS) has reviewed the Total EEtP USA Oil <br />Shale, LLC Preas Exploration Project Notice of Intent to Conduct Prospecting Operations <br />(NOI), No. P- 2014 -022, submitted December 24, 2014. The NOI has a few clarifications that <br />need to be addressed in order for the notice to be considered adequate to begin operations. <br />1. Due to the possibility of encountering groundwater please commit to the use of <br />plugging and abandoning of the proposed exploration holes with Portland cement. <br />2. Please specify the anticipated time frame from start of well drilling to well plugging <br />and abandonment. What methods will be employed to ensure aquifer isolation during <br />drilling and well plugging and abandonment? <br />3. Please review the attached reclamation cost estimate. If you agree with the <br />estimated figures please submit a reclamation bond in an approvable form. <br />Per Rule 5.3.1(b) the operator shall address all identified deficiencies within 60 days of this <br />notification. Please submit a response to the listed items as soon as possible prior to March <br />30, 2015 to allow the Division time to review your response.
