Box 1488 <br />Paonia, CO 81428 <br />Re: Bowie No. 1 Mine (Permit No. C- 1981 -038) <br />TR -59 - Incidental Boundary Revision — Loadout <br />Second Adequacy Review <br />Dear Mr. Bear: <br />The Division issued a preliminary adequacy review of TR -59 on January 14, 2015 and followed with an <br />Addendum on January 22, 2015. An adequacy response package dated February 12, 2015 was received <br />from J.E. Stover & Associates, on behalf of Bowie Resources, LLC (BRL) on February 18, 2015. The <br />Division's original adequacy items are repeated below, together with updated remarks. With the <br />exception of Item 4, all comments have been satisfactorily addressed. <br />The Decision Date for TR -59 is tomorrow, February 25, 2015. If you are unable to respond to the <br />remaining concern by that date, please request an extension. <br />DRMS 01/14: BRL modeled SEDCADA 4 for eight culverts (Culvert 20 through 27) utilizing <br />contributing drainage areas having sedimentologic characteristics representative of on the ground <br />conditions to determine the adequate minimum size of each culvert. The Division believes the <br />parameters utilized were valid to ensure the proper sizing of each culvert. Based on BRL's <br />SEDCAD 4 modeling, the Division finds that the culvert sizing and locations are adequate to <br />control run -off from the associated drainage areas derived from Map 7. (No response was <br />necessary.) <br />2. DRMS 01/14: Minor adjustments were made to the permit boundary as shown on the permit <br />maps. Are these changes to be confined to the maps only? Please update the Legal Description <br />in the permit text, as appropriate. <br />DRMS 01/22: In an Email on January 15th, Jim Stover inquired whether a metes and bounds <br />description is required, or will a simpler quarter - quarter description suffice? Rule 2.03.6(1) <br />reads, "Each application shall contain a complete and detailed legal description of the proposed <br />permit boundary..." The Division interprets this to mean that a metes and bounds description is <br />required for those portions of a permit where the boundary is irregular and does not follow along <br />quarter - quarter section lines. In the case of the Bowie No. 1 Mine, the Loadout (and power line <br />corridor to the East Mine) appear to meet the criteria. Please develop a metes and bounds <br />description(s) for any areas of the permit that can not be accurately described by reference to <br />Sections or regular portions thereof. <br />DRMS 02/24: Volume 7 Section 2.03 was amended in the February 18 submittal to reference <br />and include three new pages (15 through 17) which detail the Legal Description for the Loadout, <br />o -cb� <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
