Page 3 of 6 <br />Bestway's Brighton Combined SWSP <br />February 20, 2015 <br />Relevant Well Permit <br />64750 -F <br />Well Location <br />NE' /, NE1 /a, SEI /a, Sec 36, T1N, R67W, 6 P.M. <br />Aquifer <br />Laramie -Fox Hills <br />Allowable AF Amount <br />43.5 AF <br />Maximum Pumping Rate <br />100 gpm <br />The well is currently permitted for industrial, commercial and augmentation use. The <br />Applicant's accounting includes the 2% relinquishment requirement for the nontributary <br />Laramie -Fox Hills water. <br />The applicant has entered into a long term lease agreement with the City of Aurora <br />( "Aurora ") whereby Aurora will deliver up to 49 acre -feet of fully consumable water to the <br />South Platte River at the confluence of the South Platte River Et Sand Creek, just north of <br />Metro Wastewater Treatment Plant. The confluence is located approximately 20 miles <br />upstream of the Baseline Resource site. A 0.25 percent per mile transit loss for November <br />through March (5.0 percent overall loss) and a 0.5 percent per mile transit loss for April <br />through October (10.0 percent overall loss) has been accounted for in the replacement <br />schedule. The transit loss is subject to change depending upon current conditions. <br />In addition to replacing depletions resulting from this mining operation, the City of <br />Aurora effluent will also be used by the Applicant to replace 21.65 acre -feet of depletions <br />resulting from operation of the Bestway Concrete Well No. 1 (aka the Litvak Well, permit no. <br />67418 -F, WDID 0210164), in accordance with the Bestway Concrete Augmentation plan (water <br />court case no. 2004CW224). Since the City of Aurora effluent is being used as a replacement <br />source for this SWSP and the Litvak Well (case no. 2004CW224), the applicant's accounting for <br />this SWSP and case no. 2004CW224 must specify the total amount of effluent released and the <br />amount associated with this SWSP and the court case. <br />A monthly breakdown of depletions and replacements, including the Litvak obligations, is <br />shown on the attached Table 3. <br />Conditions of Approval <br />approve the proposed substitute water supply plan in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of January 1, 2015 through December 31, 2015, <br />unless otherwise revoked, modified, or superseded by decree. if this plan will not be <br />made . absolute by a water court action by the plan's expiration date, a renewal <br />request must be submitted to this office with the statutory fee (currently $257) by <br />November 1, 2015. <br />2. Well permit no. 67585 -F was obtained for the current use and exposed pond surface <br />area of the Parker - Dersham Pit, and well permit no. 66959 -F was obtained for the <br />current use and exposed .pond surface area of the Baseline Pit in accordance with §37- <br />90-,137(2) ,and (11), C.R.S. The Applicant is required to maintain a valid well permit for <br />the current uses at each site. <br />3. Well permit no. 75087 -F was obtained for dust suppression and concrete batching <br />purposes approved under this SWSP and must remain valid for the duration of this <br />SWSP. <br />
