2.03 APPLICATION FOR PERMIT FOR SURFACE AND UNDERGROUND COAL MINING AND <br />RECLAMATION OPERATIONS: MINIMUM REQUIREMENTS FOR LEGAL, FINANCIAL, COMPLIANCE <br />AND RELATED INFORMATION <br />2.03.1 OBJECTIVE <br />The objective of this section is to assure that the Division receives all relevant information regarding ownership and <br />control of the coal mining operations, the ownership and control of property to be affected by the operations, the <br />compliance status and history of Moffat County Mining, LLC and predecessor companies (EC), and other important <br />information.. It should be noted that the operator name was changed in 2010 to Moffat County Mining, LLC, so any <br />references to BTU Empire, BTU -EC, or EC, refer to the current operator. The Mine designation was also changed at <br />the same time to Williams Fork Mines, so any references to Eagle Mines or Eagle No. 5, 6, and/or 9 Mines, refer to <br />the current mine designation. <br />2.03.2 RESPONSIBILITIES <br />By submittal of this permit renewal application, MCM has provided the Division with a written application to perform <br />coal mining and reclamation operations as defined under Rules 1.04 (133) and 1.04 (132). <br />2.03.3 FORMAT AND SUPPLEMENTAL INFORMATION <br />MCM has endeavored to delineate information in this application as clearly and concisely as possible and consistent <br />with the scope of the various regulations involved. Special care has been taken to support all information and <br />assumptions with references to technical sources and/or other appropriate authorities. Likewise, attention has been <br />given during the development of this application to document all conclusions with sound technical data. <br />All sampling, testing, and analysis work completed in conjunction with this permit application has either been <br />performed or certified by competent, qualified persons. All laboratory analyses have been performed by experienced <br />laboratory personnel using approved standardized procedures. The laboratories utilized are familiar with the Division <br />requirements and have previously performed similar analyses. The overburden, interburden, underburden, soils, <br />water, and coal sampled from the Williams Fork Mine (formerly Eagle 5 & 9) site have been analyzed for chemical <br />and physical properties by several qualified laboratories. Dates of sample collection and analytical work are included <br />in the appropriate sections of this document. <br />Additionally, in those parts of this application where technical data is presented, the names of the personnel directly <br />responsible for its collection and analysis are identified, together with the dates of collection and analysis, and <br />description of methodologies. <br />This application reflects the efforts of a number of technical and professional organizations and personnel. <br />Considerable time, expense, and many man-hours have been devoted to the collection, analysis and organization of <br />the technical data and other information submitted in this permit application.
