Hays <br />.fpt Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit No. M -1989 -120 — Platte Valley <br />Corrective Action Extension Request Regarding Phase 2 Backfill <br />Dear Peter: <br />AGGREGATE <br />INDUSTRIES <br />Aggregate Industries (AI) submits this letter in response to the Division's monitoring inspection <br />report of the Platte Valley operation on December 1, 2014. The Division cited as a problem that <br />backfilling of Phase 2 is not in compliance with permit approved requirements and that a plan to <br />achieve compliance be submitted as a technical revision by February 14, 2015. As we discussed <br />last week by telephone, Al is requesting an extension of the corrective action due date to allow <br />time to further evaluate and develop a plan to address the backfill issue in conjunction with <br />repair of the erosion feature on the east side of the South Platte River, which is adjacent to the <br />Phase 2 area. <br />Al is consulting with its reclamation contractor with regard to these activities and will also be <br />coordinating with the Corps of Engineers regarding the erosion repair. In order to allow <br />sufficient time to develop plans and obtain any necessary 404 permitting approvals from the <br />Corps, Al respectfully requests an extension of time for the corrective action due date to March <br />14, 2015. <br />Thank you for your consideration in this matter. <br />Very truly yours, <br />.� ;J - <br />41441 <br />Connie N.
