The <br />review included an investigation of any stipulations imposed since the last permit renewal, and <br />any responses to existing stipulations received since the last permit renewal. Any stipulations <br />associated with this permit and issued over the life of this operation which are not discussed in <br />this midterm review have been complied with or terminated. <br />Permit Renewal No. 6 (RN -06) was issued with an effective date of August 18, 2012. The <br />Proposed Decision and Findings of Compliance for RN -06, dated March 7, 2013, document the <br />resolution of Stipulation No. 17 (repeated below). No new stipulations have been imposed <br />upon the King Coal Mine. <br />STIPULATION 17 <br />AS REQUIRED BY RULE 2.03.10, THE OPERATOR SHALL ADD TO THE LIST OF OTHER LICENSES AND PERMITS IN THE <br />PERMIT APPLICATION THE APPROVED WATER AUGMENTATION PLAN AND TRANSFER OF WATER WELL RIGHTS THAT ARE <br />IN PREPARATION IN RESPONSE TO THE MEMORANDUM THAT THE DIVISION RECEIVED DURING THE REVIEW OF PERMIT <br />RENEWAL 5 FROM THE OFFICE OF THE STATE ENGINEER, DATED MARCH 12, 2007. <br />COMPLIANCE WITH STIPULATION 17 <br />MINOR REVISION No. 37 (MR -37), WHICH INCORPORATED THE WATER DECREE AND AUGMENTATION PLAN INTO <br />THE PERMIT, WAS APPROVED BY THE DIVISION ON NOVEMBER 2, 2012. <br />Page 9 of 16 <br />
