King Coal Mine (C- 1981 -035) <br />Section IV — Permit Variances and Specific Approvals <br />MT -07 <br />The King Coal Mine does not fall within the Steep Slope Mining category of 2.06.5 and 4.27, so <br />no variance to approximate original contour was requested or required. However, the King I <br />Mine highwall was in place prior to August 3, 1977, making applicable the provisions of <br />4.14.1(2)(f). <br />Section V - Enforcement Actions <br />Notice of Violation (NOV) Number CV- 2012 -003 was issued to GCC Energy, LLC (GCC) on April <br />11, 2012 for failure to dispose of Coal Mine Waste in compliance with the permit and with the <br />regulations. Notice of a proposed civil penalty was issued to the operator on April 11, 2012, <br />and on July 26, 2012, the Division received full payment from GCC. The NOV was modified by <br />the Division on May 31, 2012. GCC met abatement step 1 on August 14, 2012 with the <br />submittal of an application for a technical revision (TR -20). In fulfillment of abatement step 2, <br />Coal Mine Waste placed improperly against the King I Highwall was removed and transferred to <br />the approved refuse pile. Step 2 was abated on November 30, 2012, and the NOV was <br />terminated on December 11, 2012. <br />Section VI - Identified Issues and Required Revisions <br />The Division has identified a number of instances in which the permit is inadequate with <br />respect to the Regulations for Coal Mining. Individual rules and the Division's comments <br />regarding associated sections of the permit text and maps are itemized below, for your <br />consideration and response. <br />2.03.4 Identification of Interests <br />1. Rules 2.03.4(6) (surface and coal ownership, etc. for the permit area) and (7) (surface and <br />subsurface ownership of areas contiguous to the permit) are not addressed completely in <br />King I and King II Sections 2.03.4 of the permit. Neither does the text direct the reader to <br />where the required information may be found. Please revise permit sections 2.03.4 to <br />include the required information, differentiating between those owners within the permit <br />area and those owners contiguous to the permit area. (The Division suggests that, for <br />ease of future updates, the addresses be shown in the permit text only, and not on the <br />maps.) <br />2. King I and King II Maps 002 (Surface Ownership) provide the names and addresses of the <br />surface owners of land within and contiguous to the permit area (with the exception of <br />Wiltze [spelled " Wiltze" according to County records]). It appears these maps have not <br />been updated since 2007 and 2006, respectively. Please review the information <br />represented on these maps for accuracy, and update as necessary. <br />3. King I and King II Maps 003 (Coal Ownership) were last updated in 2007 and 2006.
