As the initial T & E species report indicates, bald eagles will not be <br />affected by operations as long as water quality and cottonwood trees and habitat <br />are not affected. <br />No effects are anticipated to the peregrine falcon, as it is a migrant in the Purgatoire <br />River drainage only. <br />The Arkansas darter is found only in the lower reaches of the watershed in the <br />Arkansas River. Impacts to water quantity are not expected. Mine water discharge <br />is limited and water quality of the discharge is controlled through a tiered discharge <br />structure to limit loading to the stream through the CDPS permit. Sedimentation is <br />controlled by the use of sediment ponds and effluent limits set by the CDPS permit <br />The Canada Lynx is not found in or in the vicinity of the New Elk mine and would <br />not be affected by operations. <br />TR -68 6/10/2013 2 <br />
