The total disturbed area is in excess of the one -acre exclusion. The Water Quality Division of the
Colorado Department of Health and Environment requires under the Clean Water Act
amendments of 1987 that the owner and /or operator of any industrial facility with open
surface disturbance greater than one acre acquire a Colorado Discharge Permit.
