We note that we have made a number of changes regarding closing or <br />completing portions of the reclamation work including final pit limits and re- seeding/ <br />closeout consistent with Phase I. We are therefore requesting a release of this component <br />of the financial warranty associated therewith. <br />Further, regarding any mining or reclaim activities at Shaffers Crossing and the <br />corresponding Hydrologic Balance permit Number MLRB 1978 -208, we note that our <br />operations are not anticipated nor planned to expose any ground water and part of our <br />original submittal to Jefferson County pursuant to Ms Kraeger - Roveys' report <br />corroborates that.
