Dan Platt <br />February 4, 2015 <br />CC&V exchange water rights <br />Page 3 <br />CC&V has applied for conditional water rights and exchange rights in Case NO. 98CW115 and <br />absolute water rights and exchange rights as a co- applicant with the City of Victor in Case No. <br />10CW98. Any water adjudicated in those cases may be used for replacement. <br />Upper Arkansas Water Conservancy District ( "UAWCD ") <br />CC &V leased 100 acre -feet of fully consumable water from UAWCD in 2013, which is presently <br />stored in Pueblo Reservoir under the Town of Victor's account. This is available for delivery by <br />exchange or contract trade. <br />Several of the sediment detention ponds are located within close proximity or outside of <br />the northerly diatreme boundary in the West Beaver creek drainage basin via Grassy Creek. <br />Therefore, replacement supplies in the Beaver Creek Basin are required as a part of the subject <br />augmentation plan and SWSP. <br />Any releases must include transit losses and be coordinated with the Division 2 office <br />and the Water Commissioner. <br />CONDITIONS OF APPROVAL <br />This plan is hereby approved pursuant to Section 37 -92- 308(4) C.R.S. and the following <br />conditions: <br />1. This plan shall be valid through October 31, 2015, unless otherwise revoked or <br />modified. Should an additional SWSP be requested, the provisions of CRS 37 -92- <br />308(4) shall apply. The statutory fee of $300 will be required pursuant to CRS 37 -92- <br />308(8). Any request for an additional SWSP must be submitted to this office no later <br />than 90 days prior to the above expiration date. This is the fourth year of this plan. <br />2. Pumping from the underdrain pump back system must be measured in a manner <br />acceptable to the Division Engineer. <br />3. Accounting of water in this plan, including surface areas of all zero - discharge areas <br />within each drainage zone, identification of all ponds containing water and number of <br />days each pond contains water, pumping from the pump back system, stream <br />depletions, and replacement water deliveries must be provided to the Water <br />Commissioner (Joshua. Kasper @state.co.us) and Division Engineer <br />( Augmentation .Coordinator @state.co.us) on forms and at times acceptable to them. <br />Said accounting must be received by the 10'" of the month following the month being <br />reported. The name, mailing address, and phone number of the contact person who is <br />responsible for operation and accounting of this plan must be provided on the <br />accounting forms. The Division Engineer may require that any or all measuring devices <br />associated with the pump back system and replacement deliveries be verified for <br />accuracy by an approved meter tester. <br />4. To the extent that a portion of the UAWCD replacement water comes from Twin Lakes <br />Reservoir, that portion will be released to the control of the Division Engineer at the <br />
