Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /Slate Engineer <br />RECEIVED <br />FEB B 6 2015 <br />DIVISION OF RECLAMATION, <br />MINING AND SAFETY <br />We have received your submittal dated July 31, 2014 requesting approval of Cripple <br />Creek & Victor Gold Mining Company's (CC &V) substitute water supply plan (SWSP). The <br />current request is submitted pursuant to C.R.S. 37 -92- 308(4), referencing the plan for <br />augmentation applied for in case nos. 02CW122 and 10CW31. Judge Larry C. Schwartz <br />approved an Order submitted to the court on August 27, 2014, allowing you to obtain an <br />additional SWSP pursuant to C.R.S. 37- 92- 308(4)(b). This SWSP continues to combine both <br />court cases into one augmentation plan. Previous approvals for these cases included an <br />approval for 02CW122 from January 1, 2011 through December 31, 2011 (approval letter dated <br />August 16, 2011) and an approval for 10CW31 from November 1, 2010 through October 31, <br />2011 (approval letter dated October 22, 2010) as well as approval letters dated June 4, 2012, <br />December 5, 2012 and March 13, 2014 for the combined cases which covered both cases from <br />November 1, 2011 through October 31, 2014. <br />Notice has been provided to the objectors in both cases on July 31, 2014. No <br />comments were received during the statutory 30 -day time period. The required fee of $300 has <br />been received (transaction number 3665995). <br />PLAN OPERATION <br />CC &V operates a surface mine in the vicinity of the towns of Cripple Creek and Victor <br />that depletes stream flows. The plan's purpose is to provide replacement water to the streams <br />so as to prevent injury to senior vested water rights. <br />DEPLETIONS <br />Stream depletions occur to Fourmile Creek from various mining operations.
