Hays <br />Division of Reclamation, Mining & Safety AGGREGATE <br />1313 Sherman Street, Room 215 INDUSTRIES <br />Denver, CO 80203 <br />Re: ermit No. M- 2004 -051 — Wattenberg Lakes <br />Corrective Action Response Regarding Active Highwall <br />Dear Peter: <br />Aggregate Industries (AI) submits this letter in response to the Division's monitoring inspection <br />report of the Wattenberg Lakes operation on December 1, 2014. The Division cited as a problem <br />that the active mining face at Wattenberg exceeds the 2,000 linear feet (If) stated in the permit by <br />approximately 1,1501f and is requiring that the active face be reduced or that the permit be <br />revised to allow for more vertical highwall, which would result in an increase in the required <br />financial warranty amount. <br />Al believes that the current Mining Plan and Reclamation Cost Estimate already sufficiently <br />address the Division's concern based on the following: <br />• The Division's report states that highwall length is approximately 3,150 If. The financial <br />warranty calculation provides for reclamation of 3,000 If of highwalls, with 2,000 if <br />addressed as "active face" and 1,000 If addressed as "side slopes ". The reclamation <br />operations and unit costs associated with those activities are the same for side slope <br />reclamation and reclamation of active mine face. Both require backfilling, 3:1 sloping, <br />topsoiling and seeding. For quick reference, attached is a copy of the permit Exhibit L - <br />Reclamation Cost Estimate. <br />• Since the combined linear feet of vertical highwall associated with side slope and active <br />face reclamation only slightly exceeds the total set forth in the current mine plan and <br />financial warranty calculation, Al requests that the Division reconsider its position in this <br />matter and accept that the mine plan as it exists and combined reclamation activities and <br />financial warranty associated with those activities is sufficient. <br />• Al further believes that the current financial warranty is more than adequate to address <br />mining related disturbances since the slurry wall has been completed.
