October 3, 2002 <br />Mr. Bill Rodman <br />3613 F Street <br />Am!�k <br />AGGREGATE <br />INDUSTRIES <br />Greeley, CO 80631 <br />Re: Greeley West Operations (83"' Joint Venture Property) — Gravel Mine Well Permit <br />Dear Bill: <br />Aggregate Industries, formerly known as CAMAS Colorado, Inc., is the operator of the above - referenced <br />mine under a lease agreement with the property owner, 834 Joint Venture (Carl and Gary Hill). Due to <br />increases in production and exposed water surface at this site, the State Engineer's Office required that a <br />new well permit application be submitted for the operation. In response to the notification provided to <br />you by the State Engineer's Office regarding the application, you filed an objection to issuance of the. <br />permit. It is my understanding that, at the time you received the notice, you did not recognize the name of <br />the applicant, and you assumed that it was for a new mining operation in the area. <br />The State Engineer's Office requires that a hearing be scheduled in the matter of our permit application <br />based on its receipt ofyoru objection. With the understanding that the application is in fact for the <br />existing 83nd Joint Venture property and that it continues to be operated by Aggregate Industries, we are <br />enclosing a 600 -Foot Well Spacing Statement for your signature. This statement provides for waiving <br />the objection to issuance of a well permit by the State, and it asserts your right to protection of your well <br />from injury due to mining. <br />A waiver was previously signed by you in 1994 when the original well permit was obtained for the 83w <br />Joint Venture mine. In support of obtaining that waiver, 83' Joint Venture (Carl and Gary Hill) provided <br />you with an agreement assuring that you would be supplied with water if there were any impacts to your <br />well as a result of the mining operation. Aggregate Industries has operated the 83w Joint Venture Mine <br />under its lease agreement with the Hills since March of 1998, and as lessee we assumed the responsibility <br />of fulfilling the terms of the agreement that the Hills' provided to you. <br />The existing agreement to keep you supplied with water is in effect throughout the mining operation, and <br />h retrains as a supportive document upon which you can rely for executing the enclosed waiver. <br />Aggregate Industries has demonstrated its commitment to fulling this agreement throughout its <br />operation of the mine by providing wester to you as necessary and by drilling a replacement well for you <br />in August of 2000, and we will continue to fulfill this commitment throughout our mining operations. <br />We thank you for your time and consideration in this matter.
