I am sorry to be slow in getting <br />back to you, but I recently returned from two weeks of vacation, and I am running behind in my <br />work. <br />Based upon my review of the documentation that you sent me; it appears that the well in <br />question will qualify as a replacement well for the original well decreed in Case No. W4715, <br />decreed on October 3, 1975. The decree for the Cache La Poudre Water Users Association's <br />augmentation plan, which is referenced in the documentation that you provided to me, does <br />allow for wells that are in the plan to be replaced, without the necessity of further "action" in <br />regard to the Cache La Poudre Water Users Association's augmentation plan. It does appear <br />from the documents you provided me that the pumping rate allowable for both of the <br />"replacement" wells, taken together, will not exceed the amount decreed, and the 15 acre -foot <br />per year limitation that is a permit condition is consistent with the annual amount that has been <br />augmented by the plan and which was requested in the original application to come into the plan <br />made by Mr. Rodman. In all other respects, it appears that the two "replacement" wells, taken <br />together, are limited to no more than what is provided for in the wells' original decree in <br />W-4715. <br />Based upon all of this, I can see no objection that we would have to issuance of the draft <br />well permit <br />Sincerely, <br />William H.
