OFFICE OF THE STATE ENGINEER, STATE OF COLORADO <br />NOTICE OF A PERMIT APPLICATION TO CONSTRUCT A WELL (GRAVEL PIT) <br />IN THE MATTER OF A PERMIT APPLICATION TO CONSTRUCT A WELL (EXPOSE WATER <br />IN A GRAVEL PIT) TO BE LOCATED LESS THAN 600 FEET FROM EXISTING WELLS <br />APPLICANT: LAFARGE WEST, INC. <br />APPLICATION RECEIPT NO. 467713 <br />To: BILL RODMAN <br />WAYNE LARSON <br />AGGREGATE INDUSTRIES, WCR. INC. <br />On October 10; 2000, Lafarge West, Inc. submitted an application for a permit to expose water in <br />a gravel pit (receipt no. 467713) at a location in Sections 34 and 35, Township 6 North, Range 66 <br />West, Sixth P.M. In Weld County, Colorado. Information available to this office has shown that <br />the well may be located less than 600 feet from existing wells. Pursuant to 37 -90- 137(2), C.R.S., <br />the requested permit cannot be issued by the State Engineer unless the State Engineer finds, <br />after a hearing, that circumstances in this particular Instance so warrant That statute also <br />provides that if the State Engineer notifies the'owners of all wells within 600 feet of the proposed <br />well by certified mail and receives no response within the time set forth in the notice, no hearing <br />shall be required. <br />The persons listed above have been identified as the owners of an existing well located within 600 <br />feet or appears to be located within 600 feet of the proposed well. Notice of the application for the <br />proposed well is hereby provided pursuant to 37- 90- 137(2)(b), C.R.S., and a copy of the amended <br />permit application is attached as Exhibit A Anyone objecting to the issuing of a permit for the <br />proposed well must submit a written response to this notice not later than 5:00 p.m. on August 21, <br />2004. Such response should contain a brief and plain statement of the reasons why the State <br />Engineer should not grant a permit for the increase In use of the proposed well. If responding, <br />please direct correspondence to ioana Comaniciu and reference the above receipt number. A. <br />copy of the response should be provided to the applicant If you do not wish to participate in a <br />hearing that might result in this matter, or have previously signed a 600 -foot well spacing waiver <br />statement, no response is needed. <br />Dated this = day of 4uly 2004.
