Division of Reclamation, <br />_A7 Mining and Safety <br />1313 Sherman Street, Room 215 <br />Den.,er, CO 80203 <br />February 2, 2015 <br />Mr. Ken Coulson <br />Coulson Excavating Company <br />3609 North County Road 13 <br />Loveland, CO 80538 <br />RE: Brownwood Pit; DRMS File No. M -1979 -059; Follow -up on Unresolved Problems <br />Dear Mr. Coulson, <br />The above - mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our <br />records, the following problem was to be resolved on or before November 25, 2014. Listed <br />below are descriptions and corrective actions for the problem. Please resolve the corrective <br />action on or before February 27, 2015. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to <br />the Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />Problem Description: <br />• Failure to follow approved reclamation plan, or current reclamation plan needs to be <br />updated and clarified pursuant to C.R.S. 34- 32.5 -116 (1). The operator must revise the <br />reclamation plan to account for the clay -lined reservoir and the residence which is not <br />currently approved and which do not match the approved post- mining land use. <br />Corrective Action: <br />• The operator shall submit an Amendment Application, with the required $2,229 revision <br />fee, to update and clarify the current approved reclamation plan to reflect existing and <br />proposed activities by the corrective action date. <br />If the problem has already been remedied, please provide evidence of its completion.
