COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />February 2, 2015 <br />Mr. Ken Coulson <br />Coulson Excavating Company <br />3609 North County Road 13 <br />Loveland, CO 80538 <br />RE: Gardels Pit; DRMS File No. M- 2005 -033; Follow -up on Unresolved Problems <br />Dear Mr. Coulson, <br />The above - mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our <br />records, the following problem was to be resolved on or before October 17, 2014. Listed below <br />are descriptions and corrective actions for the problem. Please resolve the corrective action on <br />or before February 27, 2015. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to <br />the Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />Problem Description: <br />The Operator is not in compliance with the Division's exposed groundwater policy. The <br />Operator has not obtained a court approved augmentation plan or provided bonding <br />sufficient to cover alternate methods to mitigate injurious stream depletions that result <br />from mining related exposure of groundwater. <br />Corrective Action: <br />• The Operator shall complete one of the following options on or before the corrective <br />action date. <br />1) Submit a Technical Revision to the Reclamation Plan with an alternate plan for <br />installing a clay -liner or slurry wall around the two unlined groundwater ponds. <br />2) Dedicate water shares to the SEO to cover the 9.39 acres of exposed groundwater and <br />provide the appropriate documentation to the Division demonstrating that water shares <br />have been dedicated. <br />3) Post a financial warranty in an amount equal to the cost of backfilling both of the <br />unlined ponds (cost to be determined by the Division). <br />/w °F cO�O� . <br />� y <br />�Q r <br />0 <br />r° r <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us *� <br />John W.
