Mark Brown
February 5, 2014
entrance coordinates for this "secondary" access. Please include a description for the additional access as
well as the access between the two mining areas.
6.3.4 Exhibit D — Reclamation plan
6. The Applicant stated that the reclamation plan is to return the pit site to a dry creek bed, allowing the waters
to flow smoothly. Please commit to grading the creek bed during reclamation to help ensure that water will
flow smoothly through the site.
7. Please provide the Division with a plan for long -term erosion stability, specifically in regards to
preventing a head cut from migrating upstream and off -site.
6.3.12 EXHIBIT L — Permanent Man -made Structures
8. In the completeness review response, the Applicant's last two pages of the packet included signed and
notarized documents for an agreement between the landowner and the operator. These two pages are from
the Division's sample structure agreement that is included in the 110c permit application. Please provide
the first page, which lists what structure this agreement is for, of the 3 page sample structure agreement.
This concludes the Division's adequacy review of this application. This letter shall not be interpreted to mean that
there are no other technical deficiencies in your application. Other issues may arise as additional information is
supplied. Please be advised the Arthur -Mae Gravel Pit permit application may be deemed inadequate, and the
application may be denied on February 21, 2015, unless the above mentioned adequacy review items are
addressed to the satisfaction of the Division. If more time is needed to complete the reply, the Division can
grant an extension to the decision date. This will be done upon receipt of a written waiver of the
Applicant's right to a decision by February 21, 2014 and the request for additional time. This must be
received no later than the deadline date.
If you need additional information or have any questions, please contact me at Division of Reclamation, Mining
and Safety, 1313 Sherman Street, Room 215, Denver, CO 80203, by telephone at 303 - 866 -3567 x8132, or by email at
elliott.russella,state.co.us.
Sincerely,
% -
Elliott R.
