The following is my <br />review of the permit in regards to those rules. Adequacy review questions are bulleted. <br />2.03.4(1)44) and (6) -(9); Identification of Interests <br />The information required by this rule is listed in two sections of the permit. Both sections are labels <br />2.03.4 — Identification of Interests, one section is for the King I mine and the other is for the King II mine. <br />Several Maps scanned into Laserfische depict the Surface Ownership and Coal Ownership of the land <br />within and adjacent to the permit area. These maps are identified as Map 002 and 003. Map 002, <br />provides the names and addresses of the surface owners of land within and contiguous to the permit area. <br />It appears these maps have not been updated since 2006 and 2007. <br />Both sections 2.03.4 of the permit do not provide a list or a citation where the names and addresses <br />for the entities required by Rule 2.03.4(6) -(7) can be found. Please add this to permit sections 2.03.4. <br />On the surface ownership maps, the address' for the Huntington Ranches LLC., State of Colorado and <br />Bureau of Land Management are provided and these entities also appear to own the coal that has been <br />and will be mined. However, the Division could not locate the address' for the Four Daughter Coal <br />Company and Tipotsch, Richard Et al, both of which appear to own coal within the permit area that <br />either has been mined or will be mined. Rule 2.03.4(6)(a) requires the applicant to provide the names <br />and addresses of these owners. <br />• The address for Jack Wiltze a surface owner contiguous to the permit area is not listed on the surface <br />ownership map. This name and address will need to be added to the list. <br />• The application does not contain the names and addresses for the subsurface areas contiguous to any <br />part of the permit area as required by Rule 2.03.4(7). The information should be added to both permit <br />sections 2.03.4. <br />• The application does not contain a statement of all lands, interests in lands, options, or pending bids <br />on interests held or made by the applicant for lands which are contiguous to the area covered by the <br />permit are required by Rule 2.03.4(9).
