II. OBSERVATIONS AND FINDINGS <br />A reclamation cost estimate was completed with the 2014 Midterm Review of the Bowie No. <br />2 Mine permit, on October 3, 2014. Bowie Resources, LLC (BRL) provided comments and <br />additional information (with Minor Revision No. 168 and Technical Revision Nos. 91 and <br />96), and the Division completed a final reclamation cost estimate on January 30, 2015. The <br />estimated cost for completion of the approved reclamation plan is $12,035,632.12. A <br />detailed reclamation cost estimate was forwarded to BRL and is also available for review at <br />the Division office. <br />The estimated cost of reclamation has increased due to the following: <br />• Equipment operating and labor costs have increased since the reclamation cost estimate <br />for the entire operation was calculated with the last permit renewal. <br />• The Division has included costs for rehandling of refuse in Gob Piles #2 and #3, <br />consistent with the current on- the - ground refuse handling operations and recently <br />approved refuse material handling plans. Since BRL has permitted drying areas in both <br />refuse areas, up to 425,000 CY of refuse may be loosely stockpiled for drying at any <br />given time. Currently, BRL excavates the material from the drying area and trucks it <br />across the refuse area for spreading and compaction. The reclamation cost estimate <br />now includes costs for this required rehandling. <br />• The Division included costs for nuclear density testing of drying area refuse as it is <br />graded and compacted, to ensure compliance with Rules 4.11, 4. 10, and 4.09, requiring <br />compaction to ensure mass stability. <br />III. PROPOSED DECISION <br />The current required surety for the site is $11,463,358.27. The Division is proposing to <br />increase the required surety for the Bowie No. 2 Mine by $573,273.85, such that the required <br />surety for the site will be $12,035,632.12. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.032(4). Public notice of this proposed decision will be published <br />twice in the Delta County Independent as soon as possible. Requests for public hearing must <br />be submitted to the Division in writing within thirty days of the first publication in the Delta <br />County Independent. If no hearing is requested within those thirty days, the Division's <br />decision will become final. <br />The Division currently holds a performance bond consisting of corporate sureties totaling <br />$12,446,699.61; BRL will not be required to post additional bond to meet the proposed <br />increase in required surety. <br />Page 3 of 3 <br />
