The Division scheduled and conducted a bond release inspection on November 25, 2014. The <br />site inspection was conducted in accordance with Rule 3.032(2). Zach Trujillo and Janet Binns <br />of the Division, Mr. Jim Stover of J. E. & Stover Associates representing for the operator, Mr. <br />Spencer Shumate and Mr. Tom Medlin of OSM and Mr. Scott Gerwe of BLM accompanied the <br />Division during the inspection. BLM is the legal landowner of the majority of the surface within <br />the permit boundary. None of the other land owners of record attended the inspection; however, <br />all land owners were notified of the inspection by the Division. <br />One adequacy item was raised by OSM and the Division to CAM. The public notice sent by <br />CAM did not include all necessary information required by CSCMRA and the Division <br />requested that CAM publish a revised public notice. A revised public notice was run by the Daily <br />Sentinel beginning on October 24, 2014 for four consecutive weeks. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />CAM's approved reclamation plan prepared in accordance with Rule 2.05.4 is contained in <br />Volume 1, Section 3.0 of the PAP. Details of the post mine topography, backfilling and grading <br />plan, and reclamation schedule are located in Sections 3.1, 3.3, 3.8, respectively in the PAP. <br />Evaluation and inspection of the Munger Canyon Mine site and the Loma loadout site were <br />based on the specific requirements of the reclamation plan and the functional requirements of the <br />post- mining land use. <br />Reclamation was completed in the summer of 2007, with exception of the following: sediment <br />pond and associated ditch and culvert reclamation in the coal waste disposal vicinity, culvert <br />removal /dry ford construction along the retained segment of the haul /access road, and width <br />reduction of the segment of the road on private land (approximately ' /z mile in length). Currently, <br />CAM is in the process of reclaiming the sediment pond, associated ditch and culverts but is not <br />part of the SL -2 bond release application. <br />PHASE I <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released <br />when the permittee successfully completes backfilling, regrading, and drainage control in <br />accordance with the approved reclamation plan." Criteria for bond release included the <br />following: <br />1. Hillslope and drainage channel gradients and general design compliance; <br />2. Performance of the reconstructed topography. Symptoms of failure or instability such as <br />slumping or exposed highwalls were examined; <br />3. Hillslope design/function with regard to erosion; <br />4. Swales and depressions with regard to numbers of features and effect on post - mining <br />land use; <br />5. Blending of regarded land to undisturbed areas; <br />6. The functioning of drainages with regard to knickpoints, blending at disturbance <br />boundaries and channel erosion; <br />
