My comments are listed below and organized by section. If you have any further questions or comments,
do not hesitate to ask.
2.05.3(5) — Topsoil
1. A narrative about topsoil salvage and storage is in KII Section 2.05.3 page 6. The required information
is available in the narrative but a map of topsoil storage structures for King II is not available in the
permit as required by Rule 2.05.3(5). Please submit a map showing the topsoil storage structures
prepared according to the requirements of Rule 2.10.
2. The narrative in KII Section 2.05.3 page 6 states that the topsoil replacement depth will be 6 inches.
The narrative in KII Section 2.05.4 page 9 states that the topsoil finished depth will be 12 inches.
Please clarify what the final replacement depth of topsoil will be and verify that enough topsoil has
been salvaged to achieve the required depth.
4.15.7(3) — Revegetation
1. The rabbitbrush/big sage mixed shrubland community reference area was not statistically demonstrated
to be comparable with the disturbed area as required by Rule 4.15.7(3)(b). Please submit the data
demonstrating that the reference area is statistically comparable to the disturbed area.
2. On page 15 of Section KII 2.05.4, a brief description of what the reference area `will be' is given;
however, this description does not meet the requirements of Rule 4.15.7(3)(a -f). Please submit a
discussion about the reference areas which addresses: how the reference area represents the disturbed
plant community, a statistical compatibility demonstration, location, size, management and a fence
description (if one is installed).
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us
John W.
