PERMIT #: M- 1980 -183 <br />INSPECTOR'S INITIALS: TOD <br />INSPECTION DATE: January 22, 2015 <br />OBSERVATIONS <br />This inspection was conducted by Tom Kaldenbach and Tyler O'Donnell of the Division of Reclamation, <br />Mining and Safety (Division). Brannan Sand And Gravel Company, L.L.C. (Brannan), the Operator, was <br />represented by Fred Marvel, Louis Bustamante and Josh Oliver. Tom Hatton with Applegate Group Inc., the <br />consultant representing Brannan, was also present during the inspection. Norm and Charlene Einspahr the <br />adjacent landowners were present during the inspection. <br />Pit 29 is a 176.24 -acre 112c Construction Materials Reclamation Permit. Pit 29 is located in Adams County <br />approximately 0.75 mile northeast of Henderson Colorado, just southwest of E -470, and east of the South Platte <br />River. The approved post- mining land use is developed water resource. <br />This inspection was conducted to verify compliance with the requirement to eliminate flooded conditions in the <br />Einspahr pasture that is located next to Pit 29. The elimination of flooded conditions in the pasture is required <br />by an Order issued by the Mined Land Reclamation Board (Board) on November 13, 2014. Based on the Order, <br />the effective deadline for eliminating the flooded conditions in the pasture was January 17, 2015. Water depths appeared to be less one foot in most of the submerged areas. The total combined area of the <br />submerged areas appeared to be less than 1 acre. <br />The Operator's Temporary Ground Water Mounding Mitigation Plan (TR -4) specified the following activities: <br />monitoring of well MW -4, surveying of elevations on the Einspahr property, evaluation of temporary mitigation <br />options, and implementation of an appropriate temporary mitigation option.
