AN,COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Deparment of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />February 3, 2015 <br />Eugene Backhaus <br />Natural Resources Conservation Service <br />Denver Federal Center <br />Building 56, Room 2604 <br />PO Box 25426 <br />Denver, CO 80225 <br />Re: New Horizon Mine (Permit No. C- 1981 -008) <br />Technical Revision No. 65 (TR -65) <br />Addition of BB Detour Road To Permit Area. <br />Dear Mr. Backhaus: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on February 2, 2015 an <br />application to revise coal mining operations at the New Horizon Mine was considered complete for <br />the purposes of filing. The revision was submitted by Western Fuels- Colorado, LLC- All review <br />and comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />This revision application proposes to add the Montrose County BB Detour Road to the New <br />Horizon Mine permit area. The BB Road was built by Montrose County adjacent to the western <br />boundary of the existing permit area and was not constructed as part of the mining permit. The <br />proposed area is 2.83 aces and will not be mined. The only disturbance proposed is the BB Detour <br />Road will be reclaimed according to the New Horizon reclamation plan using the topsoil from the <br />permit area. The BB Detour Road will be reclaimed after the reconstruction of Montrose County <br />BB Road has been completed. The applicant is proposing additional surface disturbance outside <br />of the area currently approved for disturbance. <br />The surface coal mining operation is on land located approximately 1.7 miles Northwest of Nucla, <br />Colorado.
