uses, including steam required for hydrogen generation. <br />In July of 1975, Gary Operating Company commenced' engineering <br />studies to develop plans for additional facilities at the Fruita refinery. <br />These plans have cost the company in excess of $63,000. The plans call <br />for the enalrgement of the Intake Canal and Pumping Station, to increase <br />its capacity to at least 10.0 cubic feet of water per second of time. It <br />is expected that construction at the Intake Canal and Pumping Station will <br />commence within two and one -half years, with completion of the enlargement <br />approximately two years thereafter. <br />The Referee does find that the claimant has shown reasonable dili- <br />gence in the development of the proposed appropriation of the 4.9 cubic feet <br />of water per second of time conditionally awarddd it; and therefore concludes <br />that the above entitled application should be granted. <br />Application for a quadrennial finding of reasonable diligence shall <br />be filed in May of 1980 and in May of every fourth year thereafter so long <br />as the claimant desires to maintain this conditional water right or until a <br />determination has been made that this conditional water right has become an <br />absolute water right by reason of the completion of the appropriation. <br />It is accordingly ORDERED that this ruling shall be filed with the <br />Water Clerk and shall become effective upon such filing, subject to Judi- <br />cial review pursuant to Section 37 -92 -304 CRS 1973. <br />It is further ORDERED that a copy of this ruling shall be filed with <br />the appropriate Division Engineer and the State Engineer. <br />Done at the City of Glenwood Springs, Colorado, thisaday of <br />y4- fJ T , 197, . <br />IM D -MUSt was filed in this matter <br />Th9 foregoing ruling:is confirmed <br />and approvefl, and is made the . <br />Judgment and Decree � re of this court. <br />!IO 77 <br />Datedt -- / <br />at e <br />BY THE REFEREE: <br />r e eree <br />96er Division No. 5 <br />State of Colorado <br />
