Regarding Rich's 5/19/14 memo responding to the Vento Family's 4/23/14 letter, Rich states in the last
paragraph of his responses to "Item W' that "Historically, monitoring wells at coal mines have not been subject
to construction or operation permitting requirements for water wells under the jurisdiction of the State Engineer's
Office. However, in recent years, the Division and SEO have begun requiring that monitor wells go through a
SEO permitting process. As part of the abatement process under the Modified NOV, EFCI has filed the required
permit applications with the SEO ".
Regarding the last sentence in the paragraph above, I checked with Caleb Foy in DWR earlier this week as to
whether EFCI had filed permit applications with SEO for their monitoring wells at the Southfield Mine. According
to Caleb, they have not.
