INTEROFFICE MEMORANDUM <br />TO: DAVID BERRY <br />FROM: ROB ZUBER <br />SUBJECT: SOUTHFIELD MINE, LIST OF DIRECTIVES TO EFCI THAT ARE NOT <br />COMPLETED <br />DATE: 5/23/2014 <br />CC: DAN HERNANDEZ <br />David — <br />As requested in your 16 May 2014 e-mail, Janet Binns, Dan Hernandez and I have looked over <br />correspondence with Energy Fuels Coal, Inc. (EFCI) and developed a table itemizing all issues <br />for which we need and/or request EFCI action. This includes all permitting, site maintenance, <br />landowner- inquiry related issues for which we are on record with pending DRMS requests or <br />directives. Please note that there are no currently active stipulations for this mine. <br />The correspondence that we reviewed includes: <br />• The Renewal Number 6 adequacy items (letter dated 28 March 2014) and EFCI's <br />response (letter dated 15 May 2014) <br />• The Midterm Number 06 findings document (19 February 2013) <br />• E -mails to /from landowners and EFCI since August 2010 <br />• Inspection reports since August 2010 <br />• Letters to EFCI <br />• Records of phone conversations. <br />Please see the attached table of items. I hope it is clear, but I look forward to discussing with <br />you, if necessary. <br />Rob Zuber <br />
